limewire questions need answering

This program is like kazza right? So wouldn't that still make mp3 downloading illegal?

trap_jaw4 June 26th, 2003 11:16 PM

No. Downloading mp3s with LimeWire is not illegal, unless the creator/copyright owner of the contents forbids distributing copies of his work.

Whats the difference between limewire and kazaa? Technically they are doing the same thing as each other. What makes limewire any more legal than kazaa. Both are sharing music for free. What, specifically makes limewire any different. Its free downloads just like kazaa...

Both Kazaa and LW are legal applications. It is how one will use them that brings in the illegal factor, but NOT on the application itself: if you download only files (anything) whose distribution isn't forbidden, then everything is ok. If, on the contrary, you also dld such files then that makes YOU illegal, but not LW. If it were so, then owning a cassete recorder should also be illegal.

A copyright is automatically in place when an "author" creates a work. It becomes a legal issue when this work is published. For some useful info see:

Downloading copyrighted music (and ALL published music is copyrighted) is illegal. The author does not have to explicitly forbid its distribution. The other post is correct - LW or any p2p software are definitely not illegal. Its use for distribution and downloading copyrighted info is though. I'm not making a judgement here - just clarifying some misleading or incorrect info above.

Oh man!! I just knew there was something wrong with my post. Something went off in my head while I was tapping this thing, but I still went on and posted it.
Damn, this is pure misinformation at it's best...
Thanks norm.

Whoa--don't forget that laws are NOT the same all around the world, and forum chats are not authoritative!

--currently looks like our judges have agreed that downloading copyrighted music for personal use is legal in Canada (we pay a levy on blank media).

--uploading might also be legal if there is not intent to be a distributer.

--for now, that is. We're awaiting a CRIA appeal, a new government, and WIPO ratification.

Yes. YES! That's it! I was indeed talking about another country! Thanks stief!
