I think it's fair to say that if you were to obtain this single track that the legal system of whatever country you are in would be likely to turn a blind eye. But ..... If it came to the worst would YOU be prepared to spend several months in prison for the sake of the song? You can take the optimistic view, or the pessimistic view.
