Default Underaged nudity on the Gnutella network

On Monday August 4, my brother was given a prison sentence for having deleted file names that insinuated kp, theses files could not be verified, but just the fact of having words is enough to send you to the cooler. He had got these files of limewire, which looked as innocent as any music file you choose to download, during the download the file name changed which he only realised when he went back to his pc, he deleted them off immediatley. There was also an uploader on his pc which the prosecution failed to mention to the judge. When my brother went to give his plea, he was only shown the case file 1 hour before, his barrister advised him to enter a guilty plea otherwise he would get 18yrs, so this is what he did. The prosecution then announced that they had made an exaggeration, which the judge did not seem to impressed with & ordered a pre trial revue, his barrister announced that he had not been advised about this or he would of advised a not guily plea. My brother had his revue & on Monday we went back to court for sentence, we were advised he was a low risk & unlikely to be a risk, but he is in denial, all because he maintains he is not into this type of sick **** & if anyone ever touched his siblings kids he would be in court on a different matter. We went ino the court room to a different judge,the prosecution went over the old stuff that he had already said they exaggerated (possibly due to being a different judge & the local press being there) but also admitted these files could not be verified, he also said there was a vid of a girl tied to a bed performing oral sex, a play on word i guess, as i use the word 'girls' if im going for a night out with my mates & some of them are in there 40's. I got the impression this judge had made his mind up the minute he walked in the court room, he passed sentence of 6 months for each offence (which had already been previously advised of an exaggeration & not being able to verify theses files) the sentence totals 7yrs. Unfortunatley barristers, judges & solicitors are not computer savvy, they are dinosaurs in this area & the police know this & use it to there advantage. The police & courts are not interested in the why's & wherefore's just the fact they can recover words of your computers memory is enough to convict you. I know dozens of people this has happened too even my own kids tell me it has happened to them on an old computer we had, thank god we don't have it anymore. I have been on my brothers computer many times & never seen anything underhand, he would never let me on it if he did as he knows what a nosey cow i am. Yes, i have noticed a few adult porn sites he has viewed but what young or old lad dosn't look at adult porn even girls for that matter.
What i am saying is, in the eyes of the law it does not matter how kp got onto your computer, the fact that it is there is enough to put you in prison & the sex offenders register. It is scary **** & those that download it to keep & distribute are the one's that need seeing to. My brother refuses to lie & say that is what he is into to satisfy the legal system, if he had said what they want to hear, he would be free.
