I think you might be getting confused between .mp3 files (that you download) & making an mp3 CD

If you download .mp3 files, you can still make an Audio CD. Just add the files as usual to an iTunes playlist for burning. As long as you have Audio selected as your CD type then the mp3 files will be added to the disc & burned as an Audio CD. In this case .mp3 is just the file type, not the CD type

An mp3 CD is different - the files you add to make an mp3 CD are still compressed (that's why you can fit so many more files onto an mp3 CD). But mp3 CDs won't play in a lot of older players.

So it's not the .mp3 files that cause a problem... it's if people make an mp3 CD rather than an Audio CD.
