I cannot find the option to not share incomplete downloaded files and they are being shown as being shared.

How can I change the default behavour of this?

I don't have LW open at this very moment, but it's either LW's menu bar, Tools>Options>Sharing or Tools>Options>Saving.

The advantage of sharing incompletes is it helps speed up other people's downlds. It doesn't mean they're sharing incomplete files per se. Not unless they've accidentally added the incomplete folder as one of their shared folders.

the allow partial file sharing box is not ticked, under uploads basic, but it dosn't appear to make any difference.

If it's not ticked then it shouldn't happen. Double-check your Tools>Options>Saving to make sure it's not listed. If you see a file that's incomplete & being uploaded, then it could be a bug or you already downlded a similar file. Check your recently downlded files:

Go to your LW Library window, select Saved Files folder & press the Explore button. Sample image here: Using Library Explore button to access downld folder (click on link) & see if the same file is listed there. In the newer versions, it offers the option of sharing newly downlded files!!! So be aware of that! That can also be changed in options.

This didn't happen in a previous version of limewire, may i suggest it is a bug?
