Question tracing downloads

I was wondering who can determine my identity when I am downloading? I do understand that untimately nearly anyone can be identified but how easy is it? Is it equal to downloading from the newsgroups?

Second question is that when I am using Gnotella, I notice my modem indicator light constantly on. And when I check for modem activity, it appears that info is being sent and received even though I had upload abiliries shut off. What am I doing wrong?
