Apple does list the requirements as 10.3.9 or later, so there might be nothing to help you but that upgrade.

I've been using ffmpegX which is phenomenal for making iPod compatible videos. And they have a version that will run on 10.2.

One note. You have to use the PSP preset to make a video that will run on the iPod. That video preset automatically makes the output 320x240. But if the dimensions of your source video were anything other than 4:3 then the output will be distorted, so you need to change the output back to the right ratio.

Also, the iPod can actually support MPEG-4 video up to 480x480. It does you no good if you are watching on the iPod, but if you plan to plug the iPod into a TV to watch, then encoding the video at the higher resolution will give you better output.

Still, once you make the video's, there is no guarantee that you'll be able to get them on the iPod if you don't have the right version of iTunes and the Mac OS.
